Terms of Service

Groovequake is a 24/7 internet radio station. Artists pay a subscription to upload music that is programmed into the stream. Listeners tune in for free. The AI DJ Captain Groovequake provides commentary between songs. We make no guarantees about when or how often any specific song will play.

You must be at least 13 years old to create an account. You are responsible for maintaining the security of your login credentials and for all activity under your account.

Usernames are unique and shared across artist and listener accounts. Impersonating another person or entity is prohibited.

Email or SMS verification is required before your account is activated.

Lawful right to publish. By uploading content, you represent and warrant that you hold all necessary rights to make that content available for public broadcast, including sync rights, master rights, and any other applicable intellectual property rights.

No cover songs. Cover songs are strictly prohibited. Only original compositions may be uploaded. If you are unsure whether your content qualifies, do not upload it.

URL validity. You are responsible for ensuring that your audio URLs remain accessible. We monitor for broken links and will deactivate songs with invalid URLs. We will notify you when this occurs.

Explicit content. Explicit content is permitted but must be flagged as explicit at the time of upload. Failure to flag explicit content may result in immediate removal.

You may not upload or submit content that:

• Infringes any copyright, trademark, or other intellectual property right
• Is a cover song or unlicensed sample of another artist's work
• Contains harassment, hate speech, or incitement to violence
• Is illegal in the jurisdiction where it is created or received
• Includes malicious code or links

Artist subscriptions are billed monthly or annually via Stripe. Prices are displayed on the Pricing page and may be updated with 30 days' notice.

No refunds. All payments are final. We do not offer refunds for any reason, including partial periods, unused capacity, or content removal.

Failed payments. If a payment fails, you have 10 days to update your billing information. After 10 days, your songs will be deactivated (not deleted). You can reactivate at any time by bringing your account current.

Cancellation. You may cancel at any time. Your subscription remains active through the end of the current billing period.

Content on cancellation or payment failure. Your content is never deleted due to payment issues. Songs are marked inactive and restored when payment resumes.

We reserve the right to remove any content or suspend any account at our sole discretion, at any time, without notice, and without liability. We do not offer appeals. No refunds will be issued in connection with content removal or account suspension.

We will endeavour to notify artists when their content is removed and provide a reason where possible, but are not obligated to do so.

We comply with the Digital Millennium Copyright Act. If you believe content on the Platform infringes your copyright, send a DMCA takedown notice to dmca@groovequake.fm with:

• Identification of the copyrighted work
• Identification of the infringing material and its location on the Platform
• Your contact information
• A statement of good faith belief
• A statement of accuracy and authority under penalty of perjury
• Your physical or electronic signature

The Platform uses AI services (Anthropic Claude and ElevenLabs) to generate DJ commentary scripts and voice audio. This content is created by automated systems and does not represent the views of any individual. Artist names and song titles may be mentioned in AI-generated commentary as part of normal radio operation. By uploading content, you consent to this use.

We have one rule: “Be kind, play nice, and have fun — or use a different platform.” Violations of this rule, as determined at our sole discretion, may result in content removal or account suspension.

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We make no guarantees about stream uptime, playback frequency, or listener reach.

To the fullest extent permitted by law, Groovequake and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to lost profits, lost data, or reputational harm. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

These Terms are governed by the laws of the jurisdiction in which Groovequake is registered, without regard to conflict of law principles.

We may update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
